Human rights implications of Health and Social Care Act

The Government confirms that all "publicly funded health and care services should indeed consider themselves bound by the [Human Rights] Act". The Government made this important statement during the passage of the Health and Social Care Bill. It refused to support an amendment, supported by BIHR, which would have clarified this in law, but the statement made by the Government sends an important message to all providers of health and care services that they must protect human rights.

The Health and Social Care Act 2012 became law this month and BIHR has published a briefing on some initial human rights issues emerging from the Act.  (briefing available on the website above)
