Brown envelopes Please help!!

  • on: 26 Aug 2014 12:39PM
Everything was wonderful, I was starting to relax and then..

I get brown envelopes today.

One saying I have a WRAG interview!!!!!!!
One saying they paid money into my bank
One saying I'd been put in the WRAG!!!!!!

WHAT!!!!!  WRAG!!!!

I won my appeal, my tribunal letter says I'm in the support group...  The DWP ignored it???

In 2 seconds I've gone from happy/content to desperately heartbroken...

THIS IS UNFAIR!!  How can they override my tribunal  >crying<

No, they cannot override the result of the tribunal for the dates that the tribunal's decision is relevant - perhaps the WRAG award was for a 'closed period', ie for an earlier time that's now been and gone?  If not (ie, the dates for the WRAG decision are current and continuing) then it's the DWP office not catching up on the paperwork  >erm<

Thank you for the quick reply Kizzy, are you positively sure they cannot change it?

Do I now just wait and see what happens or should I do something like posting their letters back to them with a copy of my tribunal result?  Phoning them isn't an option.

I do but I've been going over my tribunal result papers and oh my word.. Did I get this totally wrong?

At no point does the tribunal paper say 'support group'.  It says I won, it says I'm entitled to esa with the support component (which is just the money), it says no descriptor was satisfied but regulation 35 applied and it says and I quote "if he were found capable of work or work related activities this would result in a substantial risk a significant deterioration in his mental health"

But... At no point does it say 'support group'.   So.. Am I in the support group or was the whole thing a figment of my imagination?  Because I swear the doctor at the tribunal said I was in the support group but.. It doesn't say so, does it?  I'm confused and worried.

No, it's the same as saying you're in the Support Group, just the tribunal's particular way of wording.

Regulation 35 is as good as, and equivalent to, meeting the right number of descriptors.  It's just a different route to the Support Group.  So no, you haven't misread the paperwork!

Your decision notice trumps the letter from the DWP so if anyone can take the decision notice to the wrag interview if its very soon, otherwise its a phone call or letter to then

Dear Sirs,
you have made another official error, I am not in the work related activity group but if you check her Majesty's Tribunal Service decision notice dated XXXXXX you will see I am in the support group.  Please stop trying to drive me to self harm and get your facts correct.   I would be grateful if you would notify the WRAG provider that I will not be attending and check that you have paid me the correct amounts of ESA as I believe there is a difference between the WRAG and Support group components.
Yours sincerely
Steve

something along those lines either in a phone call or a letter

Thanks for the help

Just so its clear, here is an image of my paperwork (with any identifying data removed) if someone would check it and confirm its support group and I'm not imagining things, that would be a great help.

Hi
I can confirm that you are in the Support group because point 3 states this and point 5 explains to the dwp why you met this criteria
